HIMACHAL PRADESH STATE AGRICULTURAL MARKETING BAORD,

 

1.        POWERS AND FUNCTIONS OF THE BOARD

  1. To exercise superintendence and control over all the Committees established and constituted under the Act.
  2. To coordinate the working of the Committees and other affairs thereof including programmes undertaken by such Committees for the Development of markets and market areas.
  3. To undertake the State level planning of the development of agricultural produce markets.
  4. To administer the Marketing Development Fund.
  5. To give directions to the Committees in general or any Committee in particular with a view to ensure improvement thereof.
  6. Any other functions specifically entrusted to it by this Act.
  7. Such other functions of like nature as may be entrusted to the Board by the State Government.
  8. To approve proposals for selection of new sites by the Committees for establishment of principal or sub-market yard;

9        To approve proposal for constructing infrastructure facilities in the market area such as grading, pack houses, storages, processing, other post harvest management facilities etc.

10    To supervise and guide the Committee in the preparation of plans and estimates of construction programme undertaken by the Committee.

11    To execute all works chargeable to the Boards fund.

12    To maintain accounts and get the same audited in such form and in such manner as may be prescribed;

13    To publish annually at the close of the year its progress report, balance sheet and statement of assets and liabilities and send copies thereof to each member of the Board and the State Government.

14    To undertake marketing extension activities in the Board for the transfer of marketing technology and extension services. It may It may also make necessary arrangements for propaganda and publicity on matters related to regulated marketing of an agricultural produce and development of marketing;

15    To provide facilities for the training of officers and staff of Committees and the Board after assessing the demand for trained personnel in agricultural marketing at all levels.

16    To prepare and adopt budget for the ensuing year;

17    To arrange or organize seminars/ workshops/ exhibitions, etc; on subjects related to agricultural marketing

18    To do such other things as may be of general interest to Committees or considered necessary for the efficient functioning of the Board;

19    To organize and promote grading and standardization of notified agricultural produce and e-trading.

20    To set up an Agricultural Produce Marketing Standards Bureau to perform such functions and duties as may be prescribed for the purpose of promotion of grading, standardization and quality certification of agricultural produce in the State.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

2.     POWERS AND FUNCTIONS OF APMC

 1         To enforce the provisions of this Act, and the rules and bye-laws made there under in the notified market area;

 2         To establish a market in the market area and provide such facilities for persons visiting in connection with the purchase, sale, storage,  weighment and  processing of agricultural produce concerned as the Board may, from time to            time direct;

3          Do such other acts as may be required in relation to the superintendence, direction and control of market or for regulating marketing of agricultural produce in any place in the market area, and for the purposes connected with the matters aforesaid, and for that purpose may exercise such powers and  discharge such functions as may be provided by or under this Act; and (d) do   all such other acts which may bring complete transparency in pricing system  and transactions taking place in market area.

4     To maintain and manage the market yards and submarket yards within the market area.

5          To provide necessary facilities for the marketing and facilitate the transportation of agricultural produce within the market yards and outside the yards and within the sub-market yards and outside the submarket yards in the   market area.

6          To regulate, conduct or supervise the auction of notified agricultural produce  in accordance with the provision and procedure laid down under the rules made under this Act or bye-laws of the Committee.

7          To regulate the making, carrying out and enforcement or cancellation of agreements of sales, weighment, delivery, payment and all other matters  relating to the market of notified agricultural produce in the manner prescribed.

8          To provide for the settlement of all disputes between the seller and the buyer arising out on any kind of transaction connected with the marketing of notified agricultural produce and all matters ancillary thereto.

9     To take all possible steps to prevent adulteration of notified agricultural produce;

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

1.     MANAGING DIRECTOR

1.         To exercise supervision and control over officers and staff of the Board in   matters of executive administration, concerning accounts and records and disposal of all questions relating to the service of the employees in  accordance  with the procedure as may be prescribed.

2.         To incur expenditure from the Marketing Development Fund on the sanctioned Items of work;

3.         Has the same powers as are conferred under the financial rules of the State government on the Head of the Department and exercise such other powers    and discharge such other duties as may be prescribed

4.         Has the power to transfer employees of one Committee to the Board and vice-versa on administrative grounds;

5.         In case of emergency, direct the execution or stoppage of any work and doing  of any act which requires the sanction of the Board;

6.         To prepare annual budget of the Board;

7.         To arrange for internal audit of the Board;

8.         To arrange for the meeting of the Board and maintain records of the proceedings of the meetings of the Board in accordance with the procedure as may be prescribed;

9.         To take such steps as deemed necessary for execution of the decision of the Board;

10.       To inspect the construction work undertaken by the Committees either from their own funds or loans and or grants provided by the Board or any other agencies and take corrective measures;

11.       To report such acts either of the Committees or of the Board which are contrary to the provisions laid down under this Act or rules and bye-laws  made there under to the State Government; and

13.       To take such steps as deemed necessary for effective discharge of the functions of the Board.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

2.    EXECUTIVE ENGINEER

1.         To plan and execute all the construction works of APMCs/.Marketing Board in the State as per decision of the Board               

2.         To finalize the plans and estimates for obtaining necessary financial approval  of the  competent authority.

3.         To accord technical sanction for the works to the extent of Rs.60.00 lac and  arrange to obtain necessary technical sanction from the Technical Advisor beyond Rs.60.00 lacs as per the decision of the Board.

2.         To float tenders for various construction works and to finalize the  same after completing all codal formalities.

3.         To Award the Works and to enter into agreements with the  Contractors/Firms/Architects etc.

4.         To ensure timely execution of works, inspection of works, exercise test  checks, billing and make payments thereof

5.         To monitor the working of the Assistant Engineers, Junior Engineers working  in the Board.

6.         To process the Detailed Project Reports (DPR) in respect of the Centrally Sponsored Schemes.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

3.        ASSISTANT ENGINEER

  1. To plan and execute all the civil construction works of   concerned APMCs/.Marketing Board as per the requirement and decision of the Board
  2. To check the feasibility of proposal/drawings at site.            
  3. To get prepared the estimates for obtaining necessary financial   approval of the competent authority.
  4. To float tenders for various construction works up to Rs.0.50 lac  and to process the same for  getting finalized after  completing all codal formalities.
  5. To Award the Works and to enter into agreements with the Contractors.
  6. To give lay out at the time of commencement of the work at site
  7. To ensure timely execution of works, inspection of works, exercise test checks, billing and processing for             payments thereof
  8. To monitor the working of the Junior Engineers working under the area of control.

4.        JUNIOR ENGINEER

  1. To undertake state level planning for development of markets and approve proposals for constructing infrastructure facilities in the market area such as grading, pack houses, storages, processing, other post harvest management facilities etc.
  2. To undertake marketing extension activities in the Board for the transfer of marketing technology and extension services besides making necessary arrangements for propaganda and publicity or matters related to regulated marketing of agricultural produce and development of marketing.
  3. Arrange or organize seminars, workshops/exhibitions etc. on the subject of agricultural marketing.
  4. To organize and promote grading and standardization o0f notified agricultural produced and e-trading.
  5. To set up an Agricultural Produce Marketing Standardization Bureau to perform such function and duties as may be prescribed for the purpose of motion of grading standardization and quality certification of produce.
  6. To set up and promote public private partnership in the management of markets.
  7. To promote public-private partnership for carrying out extension activities in its area viz collection, maintenance and dissemination of information in respect of production, sale, storage, processing, prices and movement of notified agricultural produce.
  8. Implementation of Agricultural and Horticulture Produce Marketing (Development and Regulation) Act, 2005.
  9. Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

9.   ADMINISTRATIVE OFFICER

 

1.   To exercise overall supervision on the entire staff of the Board and assist to secure compliance of the orders of superior authorities..

2.   Exercise delegated powers of the Drawing and Disbursing Officer as well as  head of the office of the H.P.State Agricultural Marketing Board.

3.   To exercise supervisory and monitoring of cases pertaining to establishment maters, financial control including pay fixation cases, gratuity and other  retiral benefits etc.  in respect of the staff of the Board as well as staff of the             Agricultural Produce Market Committees.

4.   Writing up of the Annual Confidential Reports in respect of the ministerial staff of the H.P.State Agricultural Marketing Board upto the level of the  Superintendent (Gr.II)

5.   To exercise supervisory check on all accounts matters of the H.P.State Agricultural Marketing Board.

6.   Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

10.   SECRETARY OF APMC

  1. To convene the meetings of the Committee and the Sub-Committees, if any, and maintain minutes of the meetings thereof.
  2. To attend the meetings of the Committee and Sub-Committee and take part in      the discussion.
  3. To take steps to give effect to the resolution of the Committee and of the Sub-Committee and report all actions taken in pursuance of such resolution to the Committee in the next meeting;
  4. To prepare the budget proposal of the Committee;
  5. To furnish to the Committee such returns,statements, estimates, statistics and reports as the Committee may from   time to time, require including following in formations
  6. To impose the fines and penalties on and any disciplinary action taken   against the members or the staff and the market functionaries and others.
  7. To exercise check on overtrading by traders.
  8. To exercise   check over contravention of the Act, the rules, the bye laws of        the standing orders, if any, by any person.
  9. The work regarding the suspension o cancellation of License by the Managing Director of the Board.
  10. Functions pertaining to the administration of the Committee and the regulation of the marketing.
  11. To produce before the Committee books, registers and other document, as may    be necessary for the transaction of the business of the Committee or the Sub-Committee, and also whenever called upon by the Committee to do so.
  12. To exercise supervision and control over the acts of all officers and servants of the Committee.
  13. To collect fees and other money livable by or due to the Committee.
  14. Responsibility for all money credited to or received on behalf of the Committee.
  15. To make disbursements of all money lawfully payable by the Committee.
  16. To operate, maintain and transact the Committee fund.
  17. Report to the Managing Director of the Board, as soon as possible, in respect       of fraud, embezzlement, theft or loss of Committee fund or property.
  18. To prefer complaints in respect of prosecutions to be launched on behalf of the Committee and conduct proceedings, civil or criminal on behalf of the Committee.
  19. Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

11.      MARKETING OFFICER

1.   Compilation, tabulation and analysis of statistically data/formulation of price  trends, weekly, monthly and yearly in respect of all the commodities marketed in market areas.

2.   Implementation Agricultural and Horticulture Produce Marketing(Development and Regulation) Act, 2005.

3.   Preparation of Annual Administrative reports/inspection reports.

4.   Preparation of Monthly arrival and dispatch reports committee wise/ commodities wise.

6.   Dealing with press news/news paper cuttings and advertisements of the activities of H.P.State Agricultural Marketing Board.

7.   Organization Seminars, propaganda and publicity of various activities of the

      H.P. State Agricultural Marketing Board.

8.   To ensure follow up action on the proceedings of the meetings of the Secretaries of the Agricultural Produce Market Committees.

9.   Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

12.      ASSISTANT SECRETARY

1.         To assist the Secretary in implementation/enforcement of the H.P.Agricultural and Horticulture Produce Marketing (Development and Regulation) Act, 2005.

2.         To assist the Secretary of the APMC in running the various day to day activities of the Market Committee smoothly.

3.         To conduct inspections of various Check Posts and barriers under the APMC

            to ensure that market fee is properly and duly realized as per the provisions of  the Act.

4.         To exercise supervisory checks over the functioning of the market Supervisor/Auction Recorders/Assistant Auction Recorders and ensure proper  management  of the  markets and to report the contravention of the Act,Rules and Byelaws      to the Secretary.

5.         To exercise supervisory check over the transaction of Agricultural Produce of  the Traders in the Principal market yard, Sub Market yard and other market area.

6.         Accounts checking of dealers whenever required.

7.         To check the Annual return of sale and purchase and to maintain the trader wise record & to report the infringement, if any.

8.         To ensure the proper implementation of the provision of the Act, Rules and Bye Laws and ensure all the forms as per the Rules.

9.         To ensure proper collection, compilation, uploading & dissemination of all  market information on prices, arrivals, dispatch, import and export etc. 

10.       To collect Market Fee under proper receipt from all the traders in the Markets/ notified market area of the APMC.

13.   MARKET SUPERVISORS

 

1.   To exercise supervisory checks over the functioning of the Auction   Recorders/Assistant Auction Recorders and ensure proper management of the markets and to report the contravention of the Act, Rules and Byelaws to  the       Secretary.

2.   To exercise supervisory check over the transaction of Agricultural Produce of  the Traders in the Principal market yard, Sub Market yard and other market    area.

3.   Accounts checking of dealers whenever required.

4.   To check the Annual return of sale and purchase and to maintain the trader wise record & to report the infringement, if any.

5.   To check the Register/ information maintained and supplied by the Buyer in FORM M & FORM N under rule 30 (4).

6.   To ensure proper checking of Return of daily purchase and sale on FORM O under rule rules 30 (4) and 37 (1).

7.   To ensure proper collection, compilation, uploading & dissemination of all   market information on prices, arrivals, dispatch, import and export etc.  

8.   To collect Market Fee under proper receipt from all the traders in the Markets/  notified market area of the APMC.

14.       AUCTION RECORDER

1.         To start and record the Auction on Form P.

2.         To ensure the proper implementation of the provision of the Act, Rules and Bye Laws and ensure all the forms as per the Rules.

3.         To collect, compile, upload & disseminate all market information on prices, arrivals, dispatch, import and export etc. 

4.         To ensure issue of proper sale voucher for the seller in FORM R under Rule 30 (17), Bill of the Commission Agent in FORM Q under rule 30 (15) (16) and agreement between the buyer and seller in form T under rule 32.

5.         To ensure proper checking of Auction and register in Form S under Rule 31 (7) in the private market yard.

6.         To maintain the Register of sale and purchase of agricultural produce on FORM W under rule 37 (2).

7.         To collect market fee where need be and to maintain account of market fee in Dealer Ledger;

8.         To assist Mandi Supervisor in accounts checking;

9.         To collect rent of the shops etc. of the APMC.

15.        ASSISTANT AUCTION RECORDER

 

 1.        To start and record the Auction on Form P.

  3. To exercise proper check over the attendance register and office decorum.
  4. To deal with any matters assigned by the Managing Director/Administrative Officer.
  5. To put up weekly arrears reports in respect of the dealing assistants.
  6. To deal with inspection notes of the officers of the Board.
  7. Co-signatory for the cheques issued from time to time for payment of retirement gratuity/death gratuity in respect of the employees of the Board/Market Committees.
  8. To ensure that the Assistant Diaries   are maintained by all the dealing assistants in the Board/Market Committees.
  9. To ensure that various periodical returns/reports are sent to the quarter concerned and received from the field offices regularly with in the stipulated period.
  10. To deal with Assembly Business respect of the Board/APMCs during the Vidahan Sabha Session.
  11. To deal with Annual Confidential Reports of the Officers/Staff of the Board/Market Committees.
  12. Checking of Cash Book.

21.  DIVISIONAL ACCOUNTANT

 

1.   Submission of monthly progress report of income and expenditure report of  APMCs.

2.   Rent recovery statement of all APMCs.

4.   Preparation of trial balance every month and submission of the same for perusal of the authorities of the Board .

5.   Preparation of the Balance sheet of the H.P.State Agricultural Marketing  Board in association with the Chartered Accountant.

6.   To put up latest position of 25% board share of Market Fee deposited by the APMCs every month.

7.   Submission of progress report regarding collection of Market Fees by the APMCs.

8.   Preparation of Boards Budget every year.

9.   Approval of final expenditure head wise viz a viz budget for the financial year ending in March every year.

10. Submission of progress report of out standing recovery position of contractors as pointed out by the Audit.

23.       LEGAL ASSISTANT

 

1.   To deal with all court cases, service matters pertains to the organization, responsible for preparation of replies to writ petitions, Appeals, suits, tribunal matters, departmental inquiries, other notices, securitization of cases, imparting legal opinions, attend the High court, Tribunals, others courts in connection with departmental cases and other administrative matters.

2.   To facilitate the Honble Chairman of the Board to adjudicate the statutory appeal/ revisions to the Government, announce judgment/decide the appeal/ representation prescribed under the Act/Rules/Statutes/Regulation/Legislation etc.

3.   To monitor the court cases and others cases in order to safeguard the interest of the Organization and to provide facilitation in legislation works, Agreements, contracts and MOU etc.

4.   To ensure proper maintenance of cases records, legal books and journals, notifications

5.   To deal with the cases with regard to criminal prosecution, civil litigation, legal notices land acquisition cases, other claim cases, cases of civil miscellaneous nature, other departmental inquires and administrative matters in which the Government affairs are closely concerned directly or indirectly

6.   To ensure to preparation of written statements, replies, rejoinders, process etc. for judicial /executive courts. Facilitate to impart legal opinions when ever required by the authorities, Screening of pronounced judgments, criminal and civil cases and interlocutory, interim orders of judicial courts. Preparing Appeal/ Revisions for Appellate court including court of judicature, Tribunal etc.

7.   To conduct the periodic review of all cases and to apprise the authorities for further action.

24.     STATISTICAL ASSISTANT

 

  1. To assist the Managing Director/ Senior Marketing Officer in Preparing/compiling stastical data relating to agricultural produce marketing activities of different Agricultural Produce Market Committees.
  2. Over all scrutiny and maintenance of record for all Statistical data.
  3. Compilation of arrivals and dispatches of all agricultural produce in different  markets of the APMCs
  4. Maintance of Statistical data relating to all the markets in the State.
  5.  Liaison with Director of Economics, Ministry of Agriculture, Govt. of India , & National Sample Survey Organisation, Govt. of India in Agriculture
  6. Statistics & Agriculture census work other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

25.      COMPUTER DATA OPERATOR

1.   Up-keepment and maintenance of infrastructure in the IT Centre.

2.   Up-keep of latest Agmarknet software and day to day scrutiny of Agmarknet price and arrival data.

3.   Correspondence with various vendors.

4.   Coordinate and conduct the computer training programmes.

5.   Faculty support during practice session.

6.   Settlement of accounts for computer programmes.

7.   Providing Software support to:

i)                   DDO Accounting System.

ii)                 Pay-bill Processing System.

10.        Annual Administration Report relating to Establishment Branch;

11.        Postings & Transfers and General Orders;

12.        Seniority Lists of all category of employees;

13.        Audit Paras relating to Establishment Branch;

14.        General Instructions on the above subjects;

15.        Miscellaneous complaints;

16.        Creation, appointment and R&P Rules etc. under Disaster Management Scheme.

17.        Cases relating to all establishment matters pertaining to HPSAMB.

18.        Correspondence relating to holding of meetings of Board.

19.        Maintenance of File Index Register;

20.        Maintenance of Assistant Diary.

21.        Maintenance of Personal Files and Service Books of all category of staff;

22.        Correspondence relating to CPF.

23.        Correspondence files of all Departments on miscellaneous matters;

1.   Diary and Dispatch work.

2.   Receipt of Dak.

3.   To assist the Senior Assistant in dealing with the PUCs .

4.   Maintenance of Diary-Dispatch Register, Peon Book, postal stamps register.

5.   Sending the dak received from various quarter to the Senior Assistants concerned as marked by the Superintendent Gr.-II.

6.   To open the dak (except Confidential and Demi-official letters) and to submit the same in dak Pad to the Superintendent (Establishment) for further action.

7.   Typing work of the office.

8.   Any other duties which may be assigned by the authorities from time to  time.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

28.      DRIVER

1.   To drive the vehicles of the Board/APMCs both light and heavy.

2.   To maintain the Log Book of the vehicle.

3.   To keep the vehicle in proper order and ensure mileage as per rules/instructions of the Government from time to time.

4.   To report the defects, if any, in the vehicle to the authorities immediately and get the vehicle repaired after obtaining prior permission of the authorities.

5.   To ensure periodical service of the vehicle from time to time.

6.   To keep the R.C., Log book and other documents of the vehicles in safe custody.

7.   Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

 

 

29.       PEON-CUM-CHOWKIDAR

1.   To carry the office files/office dak to the officers/officials concerned.

2.   To deliver office dak to various officers/officials concerned.

3.   To attend to the office work of Class-IV, what so ever is assigned by the authorities.

4.   To safe guard the security and office secrecy.

5.   To maintain office decorum and discipline.

6.   Any other duties which may be assigned by the authorities from time to time.

 

 

 

 

 

 

 

 

 

 

 

 

30.      FRASH

1.   Dusting of office furniture, Almirah and other appliances in the office.

2.   To ensure proper cleanliness of the office, machinery and equipments in the office.

31.       SWEEPER

1.   To ensure proper cleanliness of the lavaratories, toilets etc. of the office, premises and rooms of the officers/officials in the office.

2.   To clean the dustbins and garbage containers of the office, if any.

3.   Any other duties which may be assigned by the authorities from time to time.
